August 21, 2018 - Court Grants State Habeas (3.850 Motion)

August 21, 2018, state circuit court grants Mr. Kent's 3.850 motion for client Arthur Britt and resentences Mr. Britt to five years less prison, the minimum mandatory sentence permitted by law.  An earlier sentencing, which had been challenged in the 3.850 motion, had violated the mandate rule and erred in running a five year count consecutive to two other counts, one a 25 year minimum mandatory count, the other a 20 year minimum mandatory count.  The sentencing judge overruled the state's request to impose the 25 and 20 year minimum mandatory sentences consecutive to one another.
