November 17, 2008 - United States Supreme Court Grants Certiorari and Remands

November 17, 2008, the United States Supreme Court grants certiorari for Mr. Kent's client, Demarick Hunter, and remands his case to the Eleventh Circuit for further consideration in light of Begay v. United States.  Mr. Hunter was appealing the denial of a federal habeas petition under 28 U.S.C.  Section 2255, challenging his Armed Career Criminal sentence which had been predicated in part on a prior conviction for a firearm offense. 07-11550 HUNTER, DEMARICK V. UNITED STATES The motion of petitioner for leave to proceed in forma pauperis and the petition for a writ of certiorari are granted. The judgment is vacated and the case is remanded to the United States Court of Appeals for the Eleventh Circuit for further consideration in light of Begay v. United States, 553 U.S. ___ (2008).
