July 8, 2009 - Denial of Post-Conviction Motion Reversed and Remanded for Resentencing

July 8, 2009, The Florida First District Court of Appeal reversed the trial court's denial of Mr. Kent's post-conviction habeas motion for client Paul Cross, remanding for resentencing based on the trial court's misapprehension of its sentencing authority in this case involving a guilty plea to three armed robberies.  Court in fact could have departed below what it thought was a ten year minimum mandatory.
